By creating an account or using Aque ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Aque.

2. Description of Service

Aque is an AI-powered business intelligence and forecasting platform that analyzes financial and operational data to generate insights, projections, and recommendations for small and medium-sized businesses. The Service uses artificial intelligence models to process data you upload and produce outputs.

4. Your Responsibilities

You agree to:

• Provide accurate and lawfully obtained data when uploading to the Service.
• Maintain the confidentiality of your account credentials and be responsible for all activity under your account.
• Use the Service only in compliance with applicable laws and regulations.
• Not use the Service to upload data you do not have the right to share, or data that contains personally identifiable information belonging to third parties without appropriate authorization.
• Not attempt to reverse engineer, scrape, or otherwise misuse the Service.

5. Data and Privacy

6. Limitation of Liability

To the fullest extent permitted by applicable law:

• Aque and its affiliates, directors, officers, employees, contractors, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, revenue, data, business, or goodwill, arising out of or in connection with your use of or inability to use the Service.
• Aque's total aggregate liability to you for any claims arising under or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid to Aque in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
• These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if Aque has been advised of the possibility of such damages.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of dealing. Aque does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Indemnification

You agree to indemnify, defend, and hold harmless Aque and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Service, including but not limited to any content you upload, any decisions you make based on AI-generated outputs, or any violation of applicable law.

9. Intellectual Property

The Service, including all software, designs, text, graphics, and AI models, is owned by Aque and is protected by applicable intellectual property laws. You retain ownership of the data you upload. By uploading data you grant Aque a limited, non-exclusive license to process that data solely for the purpose of providing the Service to you.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, if we believe you have violated these Terms. You may terminate your account at any time through the Settings page. Sections 3, 6, 7, and 8 survive termination.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the effective date at the top of this page and, where appropriate, by email. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction, at Aque's sole discretion.
